| Misconduct Description: | The Review Board sustained the Hearing Committee's November 27, 2006 determination finding the physician guilty of gross negligence; negligence on more than one occasion; ordering tests or treatment not warranted by the condition of the patient and failure to maintain accurate records. The Review Board overturned the Hearing Committee's determination that the physician had practiced with incompetence on more than one occasion and modified the Hearing Committee's penalty. On July 10, 2008 the New York State Supreme Court, Appellate Division confirmed the Review Board's determination. On October 21, 2008 The New York State Court of Appeals denied with costs the physician's appeal. |
